§ 1 General Provisions

Pursuant to Article 37 of theGDPR, OE Technic Sp. z o.o. has not appointed a Data Protection Officer.

This Privacy Policy constitutesan integral part of the Terms and Conditions. By using the services we provide,you entrust us with your information. This document serves solely as an aid inunderstanding what information and data are collected, for what purpose, andhow they are used. Such data are of great importance to us; therefore, wekindly request that you review this document carefully, as it sets forth therules and methods of processing and protecting personal data. This documentalso establishes the rules governing the use of cookies.

We hereby declare that wecomply with the principles of personal data protection and all legalregulations provided for under the Act on the Protection of Personal Data andRegulation (EU) 2016/679 of the European Parliament and of the Council of 27April 2016 on the protection of natural persons with regard to the processingof personal data and on the free movement of such data, and repealing Directive95/46/EC (hereinafter referred to as the “GDPR”).

Upon request of the datasubject whose personal data are being processed, we shall provide comprehensiveinformation on how their personal data are used. We shall always endeavour toclearly inform individuals about the data we collect, how we use them, whatpurposes they serve, to whom they are disclosed, what protection we ensure whentransferring such data to other entities, and we shall provide informationabout the authorities to be contacted in case of any doubts.

We respect your privacy. Wewish to ensure your convenience in using our services.

We value the trust you place inus by entrusting us with your personal data for the purpose of providingservices. We shall always use personal data in a fair manner so as not tobetray your trust, and solely to the extent necessary for the provision of services.

As a User, you have the rightto obtain complete and clear information about how we use your personal dataand for what purposes they are necessary. We shall always clearly inform youabout the data we collect, how and to whom we disclose them, and provideinformation about the entities to be contacted in case of any doubts.

Article 6(1)(a) – the data subject has given consentto the processing of their personal data for one or more specified purposes;

Article 6(1)(b) – processing is necessary for theperformance of a contract to which the data subject is party, or in order totake steps at the request of the data subject prior to entering into acontract;

Article 6(1)(c) – processing is necessary forcompliance with a legal obligation to which the controller is subject;

Article 6(1)(d) – processing is necessary in order toprotect the vital interests of the data subject or of another natural person;

Article 6(1)(e) – processing is necessary for theperformance of a task carried out in the public interest or in the exercise ofofficial authority vested in the controller;

Article 6(1)(f) – processing is necessary for thepurposes of the legitimate interests pursued by the controller or by a thirdparty.

Your personal data relating to the conclusion andperformance of a contract shall be processed for the duration of itsperformance, as well as for a period no longer than that provided for byapplicable law, including the provisions of the Civil Code and the AccountingAct, i.e. no longer than 10 years, calculated from the end of the calendar yearin which the last contract was performed.

Your personal data processedfor the purpose of concluding and performing future contracts shall beprocessed until an objection is lodged.

You are entitled to thefollowing rights: access to your personal data and receipt of a copy ofpersonal data undergoing processing; rectification of inaccurate data; requestfor erasure of data (the right to be forgotten) in circumstances provided for inArticle 17 of the GDPR; request for restriction of processing in the casesspecified in Article 18 of the GDPR; objection to processing in the casesspecified in Article 21 of the GDPR; and portability of data provided,processed by automated means.

If you consider that yourpersonal data are being processed unlawfully, you may lodge a complaint withthe supervisory authority (the President of the Personal Data ProtectionOffice, ul. We comply with all applicabledata protection laws and regulations and shall cooperate with data protectionauthorities and competent law enforcement bodies. In the absence of specificdata protection legislation, we shall act in accordance with generally accepteddata protection principles, principles of social coexistence, and establishedcustoms.

§ 3 Scope and Purpose of Personal Data Collection

We process personal data solelyto the extent necessary for the provision of services and for accountingpurposes.

We collect, process, and storethe following user data:

•      full name (first name and surname);

•      residential address;

•      delivery address (if different from the residentialaddress);

•      tax identification number (NIP);

•      electronic mail address (e-mail);

•      telephone number (mobile, landline);

•      information about the web browser used;

•      other personal data voluntarily provided to us.

The provision of the above datais entirely voluntary; however, it is also necessary for the full provision ofservices.

We may transfer personal datato servers located outside your country of residence or to affiliated entities,third parties with registered offices in other countries, including countrieswithin the EEA (European Economic Area – a free trade area and the CommonMarket comprising the Member States of the European Union and the European FreeTrade Association, EFTA), for the purpose of processing personal data by suchentities on our behalf in accordance with the provisions of this Privacy Policyand applicable laws, customs, and data protection regulations.

Access to your data may begranted to entities providing services necessary for the operation of thewebsite, i.e.:

•      hosting companies providing hosting or related servicesto the Controller;

•      companies through which the Newsletter service isprovided;

•      IT service and support companies performing maintenanceor responsible for the upkeep of IT infrastructure;

•      companies intermediating in online payments for goodsor services offered within the Website (in the event of purchase transactionsconducted on the Website);

•      companies intermediating in mobile payments for goodsor services offered within the Website (in the event of purchase transactionsconducted on the Website);

•      companies responsible for the Controller’s bookkeeping(in the event of purchase transactions conducted on the Website);

§ 4 Cookies

We use cookies or similartechnologies (hereinafter collectively referred to as “cookies”), which shallbe understood as computer data, in particular text files, intended for the useof the website and stored on the end devices of Users browsing the pages.Information collected by means of cookies enables the customisation of servicesand content to the individual needs and preferences of users, as well as servesto compile general statistics on the use of pages by users. Data collectedthrough cookies are gathered solely for the purpose of performing specificfunctions on behalf of Users and are encrypted in a manner that prevents accessby unauthorised persons.

§ 6 Rights and Obligations

We have the right, and in casesspecified by law also a statutory obligation, to disclose selected or allinformation concerning personal data to public authorities or third parties whosubmit such a request for information on the basis of applicable provisions ofPolish law.

Access to personal data

The User shall have the rightto obtain access to their personal data, exercisable upon request submitted tothe Controller.

Rectification of personaldata

The User shall have the rightto request the Controller to rectify without undue delay any personal data thatare inaccurate and/or to supplement incomplete personal data, exercisable uponrequest submitted to the Controller.

Erasure of personal data

The User shall have the rightto request the Controller to erase personal data without undue delay,exercisable upon request submitted to the Controller. In the case of useraccounts, the erasure of data shall consist of the anonymisation of dataenabling the identification of the User. The Controller reserves the right tosuspend the fulfilment of the erasure request in order to protect thelegitimate interest of the Controller (e.g. where the User has breached theTerms and Conditions or where the data were obtained in the course ofcorrespondence). In the case of the Newsletter service, the User mayindependently erase their personal data by using the link included in eache-mail message sent.

Restriction of processing ofpersonal data

The User shall have the rightto restrict the processing of personal data in the cases specified in Article18 of the GDPR, including, inter alia, where the accuracy of the personal datais contested, exercisable upon request submitted to the Controller.

Portability of personal data

The User shall have the rightto obtain from the Controller the personal data concerning the User in astructured, commonly used, and machine-readable format, exercisable uponrequest submitted to the Controller.

Objection to the processingof personal data

The User shall have the rightto object to the processing of their personal data in the cases specified inArticle 21 of the GDPR, exercisable upon request submitted to the Controller.

Lodging a complaint

The User shall have the rightto lodge a complaint with the supervisory authority responsible for theprotection of personal data.
